Conditions
BOOKING CONDITIONS:
1. Reservations
(a) All reservations form the basis of a contract with Peak Fitness Challenge™.
(b) No reservation is valid unless ALL of the following conditions have been fulfilled:
(i) A signed copy of both the Booking Request Form and these Terms and Conditions has been received by our office.
(ii) Any payment required in advance has been received by our office.
(iii) Written confirmation of the reservation from our office has been received by the organisation or an authorised agent acting on behalf of the organisation. The organisation shall be deemed to have received confirmation of the booking:
(a) In the case of ordinary mail, on the second working day following the date of posting to the
address for service listed on the booking form
(b) In the case of facsimile transmission, on completion of an error free transmission, to the facsimile number provided by the organisation on the booking form.
(c) In the case of email, upon the message being sent from our computer
(c) The timetable, types of challenge and total cost are to be bookedvia the booking form (at least 4 weeks for On Campus Program, at least 4 weeks for Local Government, at least 12 weeks for Interschool Event) prior to the planned session date(s). Organisations will be contacted via phone 1-3 working days before the planned sessiondate (excludes Interschool Event entrants) to provide specific details of their booking.
(d) Organisations are welcome and encouraged to combine with other organisations in their area/cluster/district to boost student numbers or ensure there is adequate space/working facilities.
2. Payment:
(a) Organisations will be quoted a price based on the information provided (i.e. the numbers of participants expected to be involved in the session). A written quote (total cost) can be provided before a booking form is completed, quotes are valid for 30 days.
(b) Organisations will be invoiced by Peak Fitness Challenge™based on information provided on the booking form not the actual number of participants on the day. Please ensure these numbers are as accurate as possible as all costs are based on this information and the price is determined accordingly. Costs per student are based on the total number of participants to the program and the overall cost of the program as per the invoice. Any alteration of numbers participating may at Peak Fitness Challenge’s discretion result in an altered total cost.
(c) If student numbers increase prior to the booked session date, the school must provide the additional numbers as accurately as possible within 5 working days prior to the day of the program booking so that they can be charged for their participation prior to the commencement of the session.
(d) The final invoice based on the information on the booking form or above is not subject to change once the Booking Request Form and these Terms and Conditions has been received by our office signed and dated by the organisation or its authorised agents subject to Peak Fitness Challenges entitlement to do so under the terms of this contract.
3. Deposit and Method of Payment:
(a) A reservation will be held and confirmed upon receipt of a deposit of 20% of the total booking costs provided by Peak Fitness Challenge™. The deposit should accompany the booking and is non-refundable.
(b) Total payment for the reservation must be received 14 days following the invoice date which will be sent out prior to the booked session date. This includes payment for all additional activities and charges which will be detailed on the invoice.
(c) Cancellation of bookings by schools less than 4 weeks from the scheduled date will incur a penalty administration fee. This penalty will be the 20% deposit received.
(d) The administration fee will be made void if organisations book an alternate date within 90 days of the original booking, however, Peak Fitness Challenge™ does not guarantee the booking date will be available or that the total cost will remain the same.
(e) The payment may be made via cash, bank cheque, credit card or direct deposit.
4. Cancellation:
(a) Peak Fitness Challenge™ has a “No play, no pay” policy. In event of a torrential rain wash out on the day or extreme heat (+35 degrees Celsius) there will be no charge and are-schedule may be negotiated.
(b) If any participant of the organisation group booking decides for his or her own reasons not to participate in the program even though it will be made available by Peak Fitness Challenge™ , there will be no refund of any payment made by the participant.
5. Insurance
(a) All equipment provided is the property of Peak Fitness Challenge. Organisations will be charged to replace any equipment that is broken or damaged through malicious or incorrect usage.
6. Public liability
(a) The organisation agrees that no liability attaches to Peak Fitness Challenge™ as a whole or to any Peak Fitness Challenge™ employee for any damage or injury caused by, arising out of, or as a consequence of, any act performed a student, or any act or omission of Peak Fitness Challenge™, its staff or agents. Peak Fitness Challenge™ is released in relation to any temporary/ permanent/ partial/ total injury/ fatality to any student or damage to or loss of property or personal possessions arising during the course of or arising out of the program session.
(b) The staff of Peak Fitness Challenge™ is to be given authorisation to organise medical or hospital treatment as they see necessary at the expense of the student and/or the organisation.
(c) The organisation covenants that it has a current public liability insurance policy to cover any event to the extent of $20 million dollars. The organisation agrees to provide a certificates of currency of the public liability insurance policy upon request from Peak Fitness Challenge™ within 5 working days and if necessary a copy of the certificate of insurance and a copy of the public liability policy.
7. OHS and Organisation responsibilities
(a) Organisations must organise the minimum number of teachers, aides, parents or competent older students to act as officials (not required for PFC Personal Training session unless there are multiple classes participating at the one time). It is preferred that officials are organised into the necessary groups and assigned an event prior to the commencement of the session.
(b) If Peak Fitness Challenge™ is required to provide additional staff (other than the standard 1-3 staff members) to adequately facilitate the Peak Fitness Challenge™ then this will be added onto the total cost.
(c) Participants are to be organised into groups prior to the commencement of the session. Team sheets (to fill in student names) will be emailed to schools 3-4 school weeks prior to the planned On Campus session date (for PFC events where team sheets are required). Names of the students (in their assigned groups) are to be emailed to Peak Fitness Challenge™ at least 2 school weeks prior to the planned On Campus session date.
(d) Behavioural supervision of participants is the responsibility of the organisation/staff (the Peak Fitness Challenge™ does not undertake Duty of Care responsibilities). Organisations are responsible for ensuring the working area is safe for physical activity and meets Occupational Health and Safety guidelines.
(e) The Peak Fitness Challenge™ supports the SunSmart policy during Term 1 and 4.
(f) The Peak Fitness Challenge™ supports Smartplay (go to www.smartplay.com.au for more information on sport safety) hydration and fluid replacement recommendations: We encourage participants to bring drink bottles with them!
(g) The organisation acknowledges that it has ensured that each student has provided the school with adequate notice of all medical information that should be disclosed to the school and forwarded to Peak Fitness Challenge™ so that any student who has a medical or health concern has alerted a responsible staff member to the possibility that the student may have to modify their participation in the program to avoid any adverse health effects that could arise.
8. Intellectual Property Rights
(a) The organisation acknowledges that intellectual property rights are the property of Peak Fitness Challenge including but not limited to all Trade Marks and Copyright in all documents, diagrams and performances of fitness routines are the property of Peak Fitness Challenge™. The organisation covenants that its employees, students, agents and any related parties will not reproduce any of the copyright protected material that constitutes a direct or indirect infringement of the owner's rights as its own unless it is authorised by Peak Fitness Challenge™. In the event of an infringement the organisation acknowledges that it will be liable for any loss or damages that flow from the breach.
(b) The organisation and its employees acknowledges that Peak Fitness Challenge™ is a registered trademark and any unauthorised use of such material, image, name or any other form that substantially resembles the use of its trademark material as a trademark will be an unlawful contravention of the ownership rights of Peak Fitness Challenge™ . In the event of a breach the school will be liable to remedy any loss or damages that arise from an infringement of its trademark rights.
(c) The organisation covenants that it will not use any intellectual property material owned by Peak Fitness Challenge™ without the prior authority of Peak Fitness Challenge™ in writing and consented by the owner (unless prior authority has been granted).
(d) The organisation covenants to observe its obligations not to disclose to any other party any confidential information that is made known to the organisation in connection with engaging the services Peak Fitness Challenge™.
9. General Conditions
(a) This contract shall be governed by the laws of Victoria.
(b) The person signing this contract shall be deemed by Peak Fitness Challenge™ to have the authority to represent the organisation making the group booking, and enter into this contract on behalf of the school, thus binding the organisation to the terms and conditions contained therein.
(c) Each person entering into this contract agrees to accept all of the contract’s conditions.
(d) No addition, deletion, modification or other promise can be made regarding these terms and conditions, except in writing, by the Peak Fitness Challenge™.
